How does State Reorganization happen?
The process of formation of a new state has been mentioned in Article 3 of the Indian Constitution, this process is as follows-
- For state reorganisation, a proposal to create a separate state is passed by the concerned state assembly . The Union Cabinet can take a direct decision if President’s rule is imposed in the state.
- After the proposal is passed by the Assembly, the Union Cabinet gives its approval for it.
- A Group of Ministers is formed to discuss major issues of the state.
- After deliberating, the Group of Ministers submits its report to the Union Cabinet. After examining this report, the Central Cabinet again gives its approval.
- After this the Union Cabinet formulates a proposal and sends its recommendations to the President for the reorganization of the new state.
- The President sends it to the concerned Assembly to seek the opinion of its members. A time limit is set for this.
- After this the proposal is sent to the Central Government with the opinion of the state MLAs. The Home Ministry prepares a new cabinet note incorporating the opinions of state MLAs.
- After this the State Reorganization Bill is sent to the Union Cabinet for approval. After getting approval, it is presented and discussed in both the houses of the Parliament.
- After discussion, it is passed by simple majority from both the houses.
- After the State Reorganization Bill is passed by both the Houses, it is sent to the President for his approval. After the approval of the President, notification of the formation of the new state is issued. In this way a new state is formed.

Jammu Kashmir Reorganization Bill 2019
- The Government of India has abolished Article 370 and Article 35A in Jammu and Kashmir to connect Jammu and Kashmir with the stream of development. After getting approval from the President , its notification has been issued. After this notification, the special status enjoyed by Jammu and Kashmir was abolished.
- After the abolition of the special status, the Government of India has divided Jammu and Kashmir into two states through the Jammu and Kashmir Reorganization Bill 2019. The first is Jammu and Kashmir and the second is Ladakh, both these states will be union territories.
- Jammu and Kashmir has been made a Union Territory like the capital of India, New Delhi and Pondicherry, where the Legislative Assembly will be formed. All matters of police and security will remain with the Central Government and control in the state will be maintained by the Deputy Commissioner.
- Legislative Assembly will not be constituted in the state of Ladakh. Here the administration of the state will be run directly by the Deputy Governor.
