Procedure For Obtaining Indian Citizenship

How To Get Indian Citizenship

Indian citizenship is in news again. The Ministry of Home Affairs has outlined four ways to acquire Indian citizenship, as per the Citizenship Act, 1955. These provisions are detailed in sections 3, 4, 5(1), and 5(4) of the Citizenship Act, 1955, which were last amended in 2011 and 2015.

Citizenship by Birth

  • Any person born in India on or after 26 January 1950 and before 1 July 1987 will be called an Indian citizen, it is not necessary whether his parents are citizens of India or not.
  • Any person born in India between 1 July 1987 and 2 December 2004 and whose parents are Indian citizens at the time of birth, will be considered an Indian citizen.
  • Any person born in India after December 3, 2004, whose parents are both Indian citizens or at least one of whom is an Indian citizen and the other is not an illegal migrant, will be called an Indian citizen.

Citizenship by Descent

  • A person who is born outside India on or after January 26, 1950, but whose parents are Indian citizens, will get Indian citizenship by descent.
  • A person who was born outside India after December 10, 1992 and before December 3, 2004 and one of whose parents is an Indian citizen.
  • A person who was born outside India after December 3, 2004, but whose parents declare that they do not hold a passport of any other country, and get themselves registered at the Indian Embassy within one year of birth, then they will be considered Indian citizens. .

Citizenship by Registration

  • Indian citizenship can also be obtained through registration, its rules are as follows-
  • A person of Indian origin who has been resident in India for at least 7 years can obtain citizenship through registration.
  • A person who is of Indian origin, but is resident in a country other than undivided India.
  • A person who is married to an Indian citizen and has been resident in India for at least 7 years before applying for registration.

If any new area is included in India, then the people there will get Indian citizenship. For example, when Pondicherry was included in India in 1962, the people there got Indian citizenship.

Dual Citizenship

  • According to the Amended Citizenship Act 1955, no Indian citizen can take citizenship of two countries. If that person does this, then according to Section 9 of the Citizenship Act, his citizenship can be terminated. According to the provision, if any citizen of India acquires the citizenship of another country for residence or for any other reason, then the citizenship of the first country is cancelled.
  • The Government of India has made a provision of dual citizenship in OCI for those people who left India and settled in any other country after or before independence.
  • Overseas Citizenship of India (OCI) is an immigration status that allows a foreign citizen of Indian origin to live and work in the Republic of India indefinitely. Those foreign citizens who are citizens of India before or after 26 January 1950 or they or their children or grandchildren are citizens of India are given OCI card.
  • However, there are many rules for OCI card holders, such as they do not have the right to vote. Do not have the right to work in government offices. Besides, OCI card holders do not have the right to buy agricultural properties, along with this the person cannot contest any election in India.

  • After getting all the information, now you have to click on Apply Online.

  • Now a new window will open in front of you

  • Read the information given here carefully and click on Apply Online at the bottom of the form.

  • Now a form will open in front of you, in which you will be given Personal, Address, Family, Criminal Proceeding, photo / Document options, in which you have to fill the information by first clicking on Personal.

  • After entering all the information in this form, click on Save and Next.

  • After this, click on the second option Address and enter all the information.

  • Thus, you have to enter the information in all the steps and click on submit. After applying online, you can now get information about the status of the form by clicking on Online Status check.
